By scheduling service or accepting a quote from Step Thru Tubs (“We,” “Us,” or “Company”), you (“Client” or “You”) agree to be bound by these Terms and Conditions.
1. Service Agreement and Acceptance
The Client agrees to the scope of work detailed in the written Estimate or Service Agreement provided by Step Thru Tubs. This document forms the entire agreement between the parties.
2. Payment Terms
- Deposit/Payment: A deposit of 25% of the total estimated cost is required to schedule and secure materials for the service. The remaining balance is due in full upon completion of the installation, prior to our departure from the site.
- Payment Methods: We accept cash, check, credit card.
3. Cancellation and Rescheduling Policy
- Client Cancellation: If the Client cancels the scheduled service more than 5 business days before the appointment, the deposit will be refunded. If cancellation occurs within 24 hours, the deposit may be forfeited to cover material costs and scheduling disruption.
- Company Cancellation: We reserve the right to reschedule due to unforeseen circumstances, in which case a full refund of any deposit will be issued if a new date cannot be mutually agreed upon.
4. Client Responsibilities and Site Preparation
- Work Area Preparation: The Client is responsible for ensuring the work area (the bathroom) is clear of personal items, rugs, towels, and any obstructions that would prevent our technicians from safely accessing the bathtub and surrounding area before our arrival. We are not responsible for moving or storing the Client’s personal property.
5. Property Damage During Installation (Limitation of Liability)
- Accidental Damage: While our technicians take every precaution to protect your property, minor, incidental scuffs or marks to surrounding areas (e.g., walls, floors) may occur during the necessary modification process. We will clean up thoroughly after our work.
- Damage Claims: Any claim for property damage must be reported to us in writing within 24 hours of service completion. Failure to report damage within this timeframe will waive the Client’s right to a claim. We are not responsible for pre-existing damage to the tub or surrounding fixtures.
6. Product Warranty
- Warranty Period: Step Thru Tubs warrants that the modification and/or refinishing work will be free from defects in workmanship for a period of One (1) Year from the date of installation.
- Exclusions: This warranty does not cover damage due to misuse, improper cleaning, normal wear and tear, or failure to adhere to our post-installation care instructions (including the curing period).
- Non-Transferable: This warranty is valid only for the original Client and is not transferable to any subsequent owner or occupant of the property.
7. Dispute Resolution
- Good Faith Negotiation: In the event of any dispute arising out of or relating to this service agreement, the parties shall first attempt to resolve the dispute through good faith negotiation between management representatives.
- Governing Law: If negotiation fails, any legal action concerning these Terms and Conditions shall be brought exclusively in the courts of the State of Michigan.
